Terms of Service

Acceptance of Terms.

Welcome to Artminds LLC ("Artminds LLC," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application, "ArtMinds AI" ("App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Use of the App

2.1 Eligibility.

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the App.

2.2 User Account.

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating or updating your account.

2.3 Prohibited Conduct.

You agree not to:

Use the App for any illegal or unauthorized purpose.

Violate any applicable laws, rules, or regulations.

Interfere with or disrupt the App or servers or networks connected to the App.

Engage in any fraudulent or deceptive activities.

Reverse engineer, decompile, or disassemble any part of the App.

Post or transmit any harmful or malicious code, viruses, or malware.

Violate the intellectual property rights of others.

Harass, abuse, or harm other users or third parties.

2.4 Image Generation Limit.

You are limited to generating up to 25 images per day through the App. Any unused portion of your daily image quota will automatically roll over and be added to your quota for the following day. This accumulation will continue daily, subject to any limits or restrictions we may impose at our discretion.

3. Intellectual Property and Rights to Generated Images.

3.1 App Content.

The content, features, and functionality of the App, excluding user-generated content, are owned by Artminds LLC and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on any part of the App without our prior written consent.

3.2 User-Generated Content.

Images generated by users through the App ("Generated Images") are jointly owned by the user and Artminds LLC. Users have the right to use, share, and display Generated Images for personal, non-commercial purposes.

Artminds LLC retains the right to use, share, distribute, and display Generated Images for any purpose, including but not limited to promotional and commercial uses, without further consent from or compensation to the user.

4. Termination.

We may suspend or terminate your access to the App at our discretion, without notice, for any reason, including if you violate these Terms. Upon termination, you must cease all use of the App, and any provisions that should, by their nature, survive termination will continue to apply.

5. Disclaimer of Warranties.

The App is provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Limitation of Liability.

To the fullest extent permitted by applicable law, Artminds LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

7. Changes to Terms.

We reserve the right to modify or revise these Terms at any time. Any changes will be effective immediately upon posting in the App. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
